1.     AGREEMENT TO TERMS OF PRIVACY POLICY

Creativity Explored is committed to protecting your privacy when you use the Creativity Explored website. This privacy policy is an agreement between Creativity Explored and you, as the user of the Creativity Explored website. This agreement tells you when this policy is effective, what information we collect from you, how we might use it, how you can review or change the personal information you provided to us, how we may change this policy, and the steps we take to ensure that your personal information is protected. This online privacy policy only applies to information collected through this site. This privacy policy does not apply to any information we may collect from you in any place other than this website.

Creativity Explored reserves the right to change this privacy policy, without notice, at any time. Changes, modifications, additions, or deletions will be effective immediately on their posting to the Creativity Explored website. Your continued use of the site after we post any such modifications will constitute your acknowledgement of the modified policy and your agreement to abide and be bound by the modified policy.

3.     INFORMATION CREATIVITY EXPLORED MAY COLLECT

3.1     Information you provide

Creativity Explored may ask you for certain information referred to on this site as “personal information,” which includes information that pertains to your identity. Such information may include, but is not limited to, items such as your name, address, date of birth, age, gender, e-mail address, telephone number, or billing information. You may be required to provide personal information to access or use certain parts of our website or features of the site.

3.3     General Information

There may be other instances in which Creativity Explored collects information automatically from you that is more general in nature (“general information”) to make our website more useful to you. Such information may include your Internet Protocol (IP) address, web browser type, the web pages or sites that you visit just before or just after the Creativity Explored website, the pages you view on our website, and the dates and times that you visit.

3.4     Donors

In addition to the information described above, Creativity Explored collects information from donors to process the donation and/or to acknowledge the contribution including amount donated, donor comments, and gift matching information. In accordance with federal and state law, Creativity Explored keeps contact information and contribution level of donors on file.

4.     THE WAY CREATIVITY EXPLORED USES INFORMATION

Creativity Explored will primarily use the information we collect to provide products and services to you, including, but not limited to, the following:

  1. To analyze visits to the website and learn about the interests of our visitors in aggregate and also on a personal level to better understand your interests and needs, so we can improve our products and services and deliver to you the type of content, features and promotions that you are most interested in.

  2. To improve your experience with the Creativity Explored website by remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Creativity Explored website, and providing custom, personalized content and information.

  3. To send you information or materials via e-mail that is important to you. This includes for non-promotional or administrative purposes such as notifying you of major website updates, or sending you information and updates pertaining to orders you may make on the Creativity Explored website. Additionally, Creativity Explored may send promotional and fundraising communications to you unless you opt-out of receiving such communications.

  4. To acknowledge donors on our website, the donor recognition wall in our gallery, and in printed marketing materials. In addition to the above, Creativity Explored may use collected information to contact donors regarding receipts for donations, internal analysis and record keeping, and reporting to relevant federal and state agencies.

You may request to opt-out of mailing lists, or that Creativity Explored delete your personal information by contacting us as directed below. Creativity Explored also includes detailed unsubscribe information at the bottom of each e-mail it sends to you.

4.1 Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your information under the following lawful bases:

  • Your consent;

  • The performance of the contract between you and the Site;

  • Compliance with our legal obligations;

  • For our legitimate interests, which do not override your fundamental rights and freedoms.

4.2 Retention

4.3 Automatic Decision-Making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Squarespace uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Creativity Explored shares your information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

7. BEHAVIORAL ADVERTISING

We use your information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

  • We use Facebook Custom Audiences to follow the actions of users after they are redirected to our website by clicking on a Facebook advertisement. We are thus able to record the efficacy of Facebook advertisements for statistical and market research purposes. The collected data remain anonymous. This means that we cannot see the personal data of any individual user. However, the collected data are saved and processed by Facebook. We are informing you on this matter according to our information at this time. FAcebook is able to connect the data with your Facebook account and use the data for their own advertising purposes, in accordance with Facebook’s Data Use Policy found under https://www.facebook.com/about/privacy. Facebook Conversion Tracking also allows Facebook and its partners to show you advertisements on and outside Facebook. In addition, a cookie will be saved onto your computer for these purposes.

8.     PROTECTION OF YOUR INFORMATION

Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. By using the Creativity Explored website or providing personal information to us, you agree that Creativity Explored can communicate with you via e-mail regarding security, privacy, and administrative issues relating to your use of the Creativity Explored website.

9.     CHILDREN UNDER 13 YEARS OF AGE

The Creativity Explored website is a general audience site, and we do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. Creativity Explored does not solicit personal information from children. Creativity Explored website visitors under 13 years of age should remember that they are required to obtain an adult’s permission before submitting any personal information to this or any other website.

10.     THE WAY CREATIVITY EXPLORED DISCLOSES INFORMATION

We provide some of our services with qualified affiliates, services providers, partners and other third parties (collectively, “service partners”). Creativity Explored does not share personally identifiable information with third-party organizations for their marketing or promotional use: (a) unless we obtain your prior consent, or (b) as part of specific programs or features for which you will have the ability to opt-out. Creativity Explored does not share any personal information related to donations with service partners.

Creativity Explored may also release your personal or general information without your consent for security purposes, when it reasonably believes it is legally required to do so, or to prevent imminent harm to any person or entity. 12. COOKIES AND TRACKING PIXELS

12.1 Cookies

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). 12.2 Tracking Pixels

A tracking pixel is a tiny piece of JavaScript code that we have incorporated into each of our web pages. We use Facebook’s Custom Audience Pixel (also known as Facebook Pixel). This piece of code provides a series of functions for transmitting application-specific events and user-defined data to Facebook. We use custom audience pixels to record information about the way visitors use our website. For this reason, each of our web pages contains a custom audience pixel. This pixel records information about the user’s browser session, which it sends to Facebook, along with a hashed version of the Facebook ID and the URL viewed. Every Facebook user has a unique, device-independent Facebook ID that allows us to address and recognize users across a range of devices using the Facebook social network, so that we can address our visitors for commercial purposes using Facebook ads. The user information will be deleted after 180 days, until the user visits our website again. “Custom Audience from Your Website” respects your privacy. Thus, no personal information about individual visitors to the website will be disclosed to Creativity Explored and Creativity Explored can only advertise to website customer target groups in a targeted way once the customer target group has reached a critical mass. This makes it impossible for Creativity Explored to discover the identity of individual visitors.

12.3 Do Not Track

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

13.     THIRD PARTY LINKS

For your convenience and to improve the usage of the website we may insert links to third parties on this site. This privacy policy does not apply to such third party websites. These links take you outside our service and off the Creativity Explored website and are beyond our control. This includes links from partners that may use Creativity Explored’s logos as part of a co-branding agreement. The sites those links can take you to have their own separate privacy policies and although we seek to protect the integrity of our site, Creativity Explored is not responsible for the privacy practices of third parties.
